Terms & Conditions

These terms apply to the website and services supplied by Big Italiano (“we”, “us” or “our”), including catering, quotes, customer accounts, Wallet offers, loyalty, games and company staff benefits.

Using the service

You must provide accurate information, use the service lawfully and keep account and catering-access credentials secure. A workplace code may be used only by people authorised by that workplace. Tell us promptly if you suspect unauthorised access.

You must not probe security, automate abusive traffic, manipulate scans or scores, create duplicate accounts to avoid limits, interfere with other users, or use an offer or client code dishonestly. We may suspend access or void affected benefits where reasonably necessary to protect customers or the service.

Catering orders and quotes

  • An order is submitted when the service confirms receipt. A saved quote is not an accepted order unless we confirm it as one.
  • Menus, minimum quantities, lead times, available dates, collection windows and delivery areas shown for the relevant client or location apply to the order.
  • Prices are in Australian dollars. The checkout or quote will indicate the amount payable and any delivery charge. GST is included where required unless clearly stated otherwise for a business quote.
  • We may contact the order organiser to clarify details. Material changes require agreement and may change the price or timing.
  • If an item becomes unavailable, we will offer a reasonable substitute, adjustment or refund for the affected item as appropriate.

Team orders

The organiser is responsible for sharing a team-order link only with intended participants, closing it on time, checking the combined order and submitting or approving the final order. Participants are responsible for their own selections and dietary notes. A shared link should be treated as confidential within the group.

Payment, collection and delivery

Payment terms are those shown at checkout, on the quote, invoice or agreed client account. The organiser must provide safe and accurate access, loading, reception and delivery instructions. Risk in food passes on collection or delivery to the nominated location, subject to rights that cannot be excluded by law.

Delivery and collection times are targets that can be affected by access restrictions, traffic, building procedures and events outside reasonable control. We will communicate material delays where practicable.

Changes, cancellations and refunds

Contact us as soon as possible to change or cancel an order. Because food and staffing may be committed in advance, a reasonable cancellation charge may apply where disclosed or agreed and where permitted by law. We will not impose a charge for costs we have not reasonably incurred.

Nothing in these terms excludes, restricts or modifies consumer guarantees or remedies that cannot lawfully be excluded under the Australian Consumer Law. Depending on the circumstances, available remedies may include re-supply, replacement, refund, cancellation or compensation.

Food, allergens and dietary requests

Tell us about allergies and dietary requirements before the order deadline and check current information when ordering. We provide required allergen information on request. Our kitchens handle common allergens, and while we take reasonable care, we cannot promise an allergen-free environment unless we expressly agree otherwise. Dietary labels describe the recipe or available information; they are not medical advice.

If a person has a severe allergy, contact us directly before ordering so we can explain what can safely be accommodated.

Offers, Wallet and loyalty

  • Each offer’s displayed venue, eligibility, expiry, redemption window and specific terms apply in addition to these terms.
  • Offers and loyalty benefits have no cash value, cannot be resold and may not be combined unless stated.
  • Wallet activation does not complete redemption. Staff must validate or redeem the offer at the counter.
  • We may correct an obvious error, void fraudulent or duplicated claims, or pause a campaign for security or operational reasons.
  • If we end a loyalty program, we will provide reasonable notice and treatment of accrued benefits where practicable and required by law.

Promotional games

Games are available only when enabled and are subject to their displayed dates, entry limits, eligibility and prize terms. Automated, manipulated or duplicate entries may be disqualified. Any trade-promotion permit or additional conditions required for a particular campaign will be shown with that campaign.

Accounts and communications

You are responsible for activity under your account and should use a strong, unique password. We may send essential service, security, order and redemption messages. Marketing is optional and can be stopped using the unsubscribe facility without closing the account.

Website availability and intellectual property

We may maintain, change or temporarily suspend parts of the service. We do not guarantee uninterrupted availability. Our branding, copy, menu presentation, software and artwork remain ours or our licensors’ and may not be commercially reused without permission.

Liability

To the maximum extent permitted by law, we are not responsible for indirect or consequential loss that was not reasonably foreseeable, or loss caused by inaccurate information, misuse, an unauthorised shared link, or events outside our reasonable control. This does not limit liability or rights that cannot lawfully be limited.

Privacy, law and contact

Our Privacy Policy explains how we handle personal information. These terms are governed by the laws of Victoria, Australia, and applicable Commonwealth laws.
